Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy ("Policy") describes how MOTA Care LLC ("MOTA," "we," "us," or "our") collects, uses, shares, and protects health-related and genetic information when you use our website, mobile application, and related services (collectively, the "Services"). This Policy supplements MOTA's general Privacy Policy, and specifically addresses the categories of information that receive special protection as consumer health data and genetic data under California, Washington, Connecticut, Nevada, and other applicable state laws.
If anything in this Policy conflicts with MOTA's general Privacy Policy as it relates to health or genetic information, this Policy controls.

1. What This Policy Covers

This Policy applies to information that identifies, or could reasonably be used to identify, your past, present, or future health status, and to information about your genetic makeup — including the information you provide when you set up your MOTA profile and when you use features like your personalized action plan and the HRT Companion.
This Policy applies to you no matter which U.S. state you live in.

2. The Health and Genetic Information We Collect

Depending on how you use MOTA, we may collect the following categories of information directly from you:
  • Genetic testing status and mutation type (for example, whether you have tested positive for a BRCA1 or BRCA2 mutation)
  • Personal and family cancer history
  • Age
  • Sex assigned at birth and reproductive or family-planning information
  • Menopause-related information
  • Surgical history or status related to your care journey
We collect this information only when you provide it to us — for example, when you set up your profile, answer questions to generate your personalized action plan, or use the HRT Companion.

3. How We Use This Information

We use the information described above to:
  • Generate your personalized, NCCN-guideline-based action plan
  • Power optional features like the HRT Companion
  • Provide the other core functions of the Services you request
We do not use your health or genetic information for advertising or marketing, and we do not use it to train artificial intelligence models.

4. When and With Whom We Share This Information

We do not sell your health or genetic information.
We share this information only in limited circumstances, and only for the purposes described in this Policy:
  • HRT Companion. If you choose to use the HRT Companion, only certain anonymized profile fields — genetic mutation type, age, surgical history, menopause status, and personal/family cancer history — are shared with Anthropic solely to generate your responses within that feature. Before this happens, we ask for your permission, described in Section 5 below.
  • Service providers. We may share information with vendors who help us operate MOTA, under contracts that require them to protect your information and use it only to provide services to us.
  • Legal requirements. We may disclose information if required by law, such as in response to a valid subpoena or court order.
We do not share your health or genetic information with employers, insurers, or data brokers.

5. Your Genetic Information

Because genetic information deserves extra care, we handle it with additional protections:
  • We give you control over your genetic mutation status, including how it is used and whether it is shared with a third party to provide the Services you request.
  • You may withdraw this permission at any time. Withdrawing is just as easy as giving it.
  • You may ask us to delete your genetic information at any time. Because we do not collect a biological sample, there is no separate sample to destroy.
  • We will not use your genetic information for marketing, or share it with anyone for research purposes, without asking you first.

6. Your Rights

You have the right to:
  • Access the health and genetic information we have about you
  • Correct inaccurate information
  • Delete your information
  • Withdraw any permission you've given us for a specific use
  • Appeal a decision if we deny a request you've made under this Policy
To exercise any of these rights, contact us at hello@mota.care. If we deny your request, you may appeal by replying to our decision, and we will respond to your appeal within 45 days.
We will not discriminate against you, or provide you with a lower level of service, because you exercised any of these rights.

7. How Long We Keep This Information

We retain your health and genetic information for as long as your account is active, or as needed to provide the Services. If you delete your account, we will delete this information, except where we are required to retain it by law.

8. Keeping This Information Secure

We use administrative, technical, and physical safeguards designed to protect your health and genetic information. If we ever experience a security incident affecting this information that requires notice under applicable law, we will notify affected users, and any government agencies required by law, consistent with our legal obligations.

9. Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will notify you before those changes take effect, using the same methods described in our general Privacy Policy.
